The European Commission proposed the Affordable Housing Act<\/strong> on 9 September, aiming to support Member States and cities in addressing housing affordability and availability in the areas facing the greatest pressure.<\/p>\n

For the short-term rental market, the proposal is particularly significant, as the new framework clarifies the conditions under which national and local authorities will be able to impose restrictions on short-term rentals<\/strong>. Before introducing such measures, authorities will have to demonstrate that short-term rental activity has contributed to housing affordability or availability problems for at least three years<\/strong> and that the restrictions are targeted, necessary and proportionate.<\/p>\n

A new European framework for areas under housing pressure<\/h2>\n

The European Commission\u2019s announcement states the following:<\/p>\n

The shortage of affordable housing has become one of the most pressing concerns for Europeans. According to the latest Eurobarometer survey, more than 50% of city residents consider housing an immediate and urgent problem in the area where they live.<\/p>\n

The proposal unveiled today seeks to address these concerns. The housing crisis is also weakening Europe\u2019s competitiveness by limiting labour and educational mobility, making action essential.<\/p>\n

In some cities and popular tourist destinations, where housing pressures are particularly acute, the growing use of residential properties for purposes other than primary residence can further reduce the local availability and affordability of housing.<\/p>\n

The Affordable Housing Act<\/strong> addresses these highly localised needs. It provides public authorities with greater legal certainty when they decide to take action based on local circumstances and within the framework of EU law.<\/p>\n

Some Member States have already introduced measures to ease these pressures but have faced legal challenges and questions over whether their policies comply with EU law.<\/p>\n

The Affordable Housing Act provides greater clarity and predictability, responding to calls from Member States and municipalities for stronger legal certainty regarding the measures they can adopt within the EU single market.<\/p>\n

European Commission President Ursula von der Leyen<\/strong> said:<\/p>\n

\u201cOne year ago, I committed to tackling the issue of affordable housing in Europe. Today, we are taking a step in that direction by providing greater clarity and support to local authorities and communities, based on the conditions they face on the ground.<\/p>\n

\u201cThe shortage of affordable housing is a source of concern for so many Europeans. Essential workers and students can no longer afford to live where they work and study.<\/p>\n

\u201cBut above all, this is a matter of fairness. Today, we are delivering for all Europeans.\u201d<\/p>\n<\/blockquote>\n

Legal certainty for authorities protecting housing affordability and availability<\/h3>\n

For the first time, the Affordable Housing Act establishes a common European framework for assessing housing-related measures that affect the single market.<\/p>\n

The decision on whether to intervene\u2014and which measures to adopt\u2014will remain with the competent authorities. Housing policy choices will continue to be made at national, regional and local level.<\/p>\n

The Act is designed to provide authorities with legal clarity when they decide to take action in areas under housing pressure, while safeguarding the single market and fully respecting the principle of subsidiarity.<\/p>\n

The new rules are intended to help the competent authorities identify \u201careas under housing pressure\u201d using a common methodology.<\/p>\n

If authorities decide to restrict certain uses of residential properties\u2014for example, as short-term rentals or vacant homes\u2014they will have to demonstrate that these uses contribute to local housing pressures. They must also ensure that any measures introduced are targeted, necessary and proportionate.<\/p>\n

What the proposal provides for short-term rentals<\/h2>\n

Regarding short-term rentals, the proposal states that any measure should target activities that reduce the housing stock available for long-term use, particularly when their scale, frequency or commercial nature exacerbates housing pressure.<\/p>\n

Before imposing restrictions, the competent authorities will also have to demonstrate that short-term rental activity has had significant negative effects on housing affordability or availability for at least three years<\/strong>, and that less restrictive measures would not be equally effective.<\/p>\n

Authorities will also be required to implement and enforce the EU Short-Term Rental Regulation, including registration requirements and the removal or deactivation of listings that fail to comply with them.<\/p>\n

Where available, they should also use data collected under the Regulation to support their assessments.<\/p>\n

Second homes and vacant properties<\/h3>\n

Short-term rentals are not the only form of non-primary residential use that can intensify housing pressures.<\/p>\n

Authorities are also adopting measures affecting the acquisition or use of residential property, for example to address the impact of second homes or homes that remain vacant for extended periods.<\/p>\n

The Affordable Housing Act provides a clearer framework for these types of intervention as well.<\/p>\n

The Act protects legal certainty and legitimate expectations. Conditions linked to property purchases cannot be applied retroactively, appropriate transitional arrangements must be provided, and measures addressing the long-term non-use of properties must take account of justified periods during which a home remains unoccupied or unused.<\/p>\n

What it means for residents and the property market<\/h3>\n

For residents of areas under housing pressure, the aim is to ensure that measures adopted at local level are better targeted, more firmly evidence-based and periodically reviewed.<\/p>\n

At the same time, restrictions should be accompanied by measures that increase the supply of housing.<\/p>\n

Property owners and investors operating across multiple local markets are expected to benefit from greater clarity regarding the applicable European legal framework.<\/p>\n

Increasing housing supply<\/h3>\n

The proposal is accompanied by a Recommendation on housing affordability and supply in areas under housing pressure.<\/p>\n

The Recommendation supports authorities in their efforts to increase housing supply where it is most urgently needed, including through:<\/p>\n

    \n
  • faster urban planning procedures;<\/li>\n
  • faster permitting for new construction;<\/li>\n
  • building renovations;<\/li>\n
  • the reuse and conversion of existing buildings; and<\/li>\n
  • measures facilitating investment.<\/li>\n<\/ul>\n

    Authorities are also encouraged to coordinate their efforts to increase housing supply through Housing Acceleration Plans.<\/p>\n

    Together, the legislative proposal and the Recommendation are intended to help authorities protect housing affordability and availability while accelerating the additional housing supply needed across the EU.<\/p>\n

    The Act is one component of the European Affordable Housing Plan, alongside new State aid rules for affordable housing and the European Strategy for Housing Construction.<\/p>\n

    Next steps<\/h3>\n

    The legislative proposal will now be submitted to the European Parliament and the Council of the European Union under the ordinary legislative procedure.<\/p>\n

    At the same time, the European Commission will continue working closely with Member States and all relevant stakeholders on the implementation of the European Affordable Housing Plan.<\/p>\n

    Background<\/h3>\n

    The Affordable Housing Act delivers on the commitment made by European Commission President Ursula von der Leyen in her September 2025 State of the Union address, when she announced that the Commission would address housing affordability through a legislative initiative.<\/p>\n

    It is a flagship initiative under the European Affordable Housing Plan and complements EU action to mobilise public and private investment in social and affordable housing, while reducing the time and cost involved in building and renovating homes.<\/p>\n
