A significant court ruling for the short-term rental sector and local authorities has annulled charges for the accommodation levy, along with the related fines, imposed on a short-term rental company for the years 2019, 2020 and 2021.<\/p>\n

The ruling, Decision No. A6821\/2026 of the Administrative Court of First Instance of Athens, is particularly significant because it addresses the legality of imposing municipal charges on short-term rentals before the levy was explicitly extended to the sector under Greek law.<\/p>\n

According to the Association of Short-Term Rental Companies (STAMA Greece), the court found that short-term rentals were governed, during the period in question, by the specific legal framework established under Article 111 of Law 4446\/2016. As a result, the accommodation levy could not be imposed without a clear and specific legal provision.<\/p>\n

The key issue concerning the accommodation levy<\/h2>\n

The ruling is linked to the point at which the Greek legislator explicitly extended the application of the levy to short-term rentals.<\/p>\n

The relevant provision was introduced under Law 5073\/2023 and entered into force on January 1, 2024<\/a>. Therefore, according to the court ruling and information provided by STAMA, the levy could not be imposed for earlier tax years by relying on a broad interpretation of the legal framework that was in force at the time.<\/p>\n

In other words, the fact that the legislator expressly introduced the levy for short-term rentals from 2024 onwards was a key element in the case. The subsequent legislative provision could not serve as the legal basis for imposing charges retroactively for previous years.<\/p>\n

The case concerns a short-term rental company in Athens that had been assessed the accommodation levy, together with the relevant fines, for the years 2019, 2020 and 2021. The Administrative Court of First Instance of Athens annulled the relevant assessments.<\/p>\n

Legal certainty at the heart of the ruling<\/h3>\n

The ruling also places particular emphasis on the principles of legal certainty and the protection of the legitimate expectations of taxpayers and other regulated parties.<\/p>\n

The central reasoning is that financial charges must be based on a clear legal provision and cannot arise from an expansive interpretation of rules that do not explicitly establish the relevant obligation.<\/p>\n

This issue is particularly important for the short-term rental sector, which in recent years has faced a constantly evolving tax and regulatory framework.<\/p>\n

STAMA argues that the ruling confirms that new financial obligations cannot be applied retroactively to periods during which they were not clearly provided for by law.<\/p>\n

What applies from January 1, 2024<\/h2>\n

The ruling does not abolish or challenge the current regime governing short-term rentals from 2024 onwards.<\/p>\n

As of January 1, 2024, Law 5073\/2023 explicitly extended the application of the accommodation levy to short-term rentals. The court ruling therefore concerns retroactive assessments for periods up to and including 2023, and not the obligations introduced and applicable from 2024 onwards.<\/p>\n

STAMA President Vassilis Argyrakis described the ruling as an important vindication both for the company involved and for the proper interpretation of the legal framework governing short-term rentals.<\/p>\n
