{"id":28593,"date":"2025-04-23T14:18:42","date_gmt":"2025-04-23T11:18:42","guid":{"rendered":"https:\/\/bnbnews.gr\/?p=28593"},"modified":"2025-04-29T18:41:46","modified_gmt":"2025-04-29T15:41:46","slug":"stama-positive-development-the-council-of-state-s-decision-on-the-business-tax","status":"publish","type":"post","link":"https:\/\/bnbnews.gr\/en\/str-insights\/28593\/stama-positive-development-the-council-of-state-s-decision-on-the-business-tax\/","title":{"rendered":"Stama: Positive development the Council of State\u2019s decision on the business tax"},"content":{"rendered":"<p><strong>Stama Greece<\/strong> describes as <strong>an &#8220;important judicial and institutional development&#8221;<\/strong> the <a href=\"https:\/\/bnbnews.gr\/en\/legislation\/28567\/airbnb-alert-greece-s-top-court-says-no-to-business-tax-per-property\/\">decision of the Second Chamber of the Council of State<\/a>, which placed itself against the imposition of the tax of 600 euros per accommodation managed by legal entities.<\/p>\n<p>Specifically, the Association of Short Term Rental Companies states in a statement:<\/p>\n<p>&#8220;With decision No. 601\/2025 of the Second Chamber of the Council of State, a positive judgment was pronounced &#8211; in the first phase &#8211; on our Association&#8217;s appeal against the imposition of the business tax of 600 euros per accommodation managed by legal entities in the short-term rental sector.<\/p>\n<p>This decision represents a particularly important judicial and institutional development, which strengthens our argument and recognises the need for constitutional compliance with any tax or administrative burden.<\/p>\n<p>Stama, as the <strong>competent institution representing the legal entities of the sector<\/strong>, is the body primarily responsible for defending legality and justice in our market and it was it and its members who appealed against the specific circular.<\/p>\n<p>We would like to stress that <strong>our legal team<\/strong> worked systematically and tirelessly to substantiate this appeal, clearly demonstrating the incompatibility of the imposition of the fee with the constitutional principles of fiscal equality, legality and good administration.<\/p>\n<p>The case was referred to the Plenary Session of the Council of State for final judgment.
